Who we are and acceptance

Nova Well is operated by trista cummings ("we", "us"). By creating an account or continuing to use Nova Well, you agree to these terms and confirm you are of legal age to enter into them. If you don't agree, please don't use the service.

Not medical treatment

Nova Well is a self-tracking and wellness tool. It does not diagnose, treat, cure, or prevent any condition, including substance use disorders, and does not replace professional care. If you're in crisis, call or text 988 (US) or your local emergency number.

Your account

Keep your login details confidential. You're responsible for all activity under your account and for providing accurate information.

Payments and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms.

Premium renews automatically each month or year until cancelled. You can cancel anytime and keep access until the end of the paid period. See our Refund Policy for details.

Acceptable use

You must not misuse the service, including: unlawful use, fraud or spam, infringing others' intellectual property, or interfering with the service's security (for example malware, probing, or scraping), or attempting to access other people's data.

Intellectual property

We own Nova Well and all of its intellectual property, including the software, documentation, and branding. We grant you a limited, non-exclusive, non-transferable right to use the service within your plan. You may not reverse engineer, resell, or redistribute the service, or circumvent its technical limits. Your entries remain yours; you grant us a limited license to host and process them solely to provide the service.

Service level and warranties

We work hard to keep Nova Well available, but we don't guarantee uninterrupted or error-free performance. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

Liability

To the fullest extent permitted by law, we are not liable for indirect, consequential, or special damages (including loss of profits, data, or goodwill), and our aggregate liability is capped at the fees you paid in the 12 months before the claim. Nothing in these terms excludes liability for fraud, death, or personal injury where the law does not allow it.

Suspension and termination

We may suspend or terminate your access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. When your account ends, you can export your data first from Settings; after deletion, your data is permanently removed.

Changes

We may update these terms and will let you know about meaningful changes. Continued use after changes take effect means you accept them.
